Terms and Conditions

1. Acceptance of terms

By accessing or using Bestorant websites, products, APIs, and services, you agree to be bound by these Terms and our Privacy Policy.

2. Eligibility and account responsibilities

  • You must be legally capable of entering into a binding contract.
  • You are responsible for account security, credentials, and activity under your account.
  • You must provide accurate onboarding and contact information.

3. Service scope

Bestorant provides software and communications tooling for restaurant operations and marketing. Merchants are independently responsible for food preparation, quality, allergen handling, pricing, and fulfillment.

4. SMS, calling, and telephony terms

Our services may include outbound and inbound calling and messaging workflows. By opting in and/or using these features, you acknowledge and agree that:

  • Call and text workflows may use automated technologies.
  • Message/data rates may apply and message frequency may vary.
  • You may opt out of SMS by replying STOP and request assistance by replying HELP.
  • Opting out may limit some service functionality.

5. Twilio-powered voice and messaging infrastructure

Bestorant uses Twilio and related telecom providers for phone number provisioning, SIP trunking, call routing, and custom logic via Twilio Functions. You acknowledge that delivery and call quality depend on carrier networks and third-party systems.

Twilio acts as a subprocessor for relevant voice and messaging functions and may process phone numbers, call metadata, SIP signaling records, recordings/transcripts where enabled, and Twilio Functions execution logs solely to provide communications services on our behalf, subject to applicable law and contractual safeguards.

  • We do not guarantee uninterrupted telephony connectivity or message delivery timing.
  • Carrier filtering, regional rules, and outage events may affect delivery and call completion.
  • You are responsible for obtaining required end-user consents before messaging/calling where required by law.

6. Acceptable use

You agree not to:

  • Use the services for unlawful, fraudulent, abusive, or deceptive activity.
  • Upload malware, interfere with platform security, or attempt unauthorized access.
  • Harvest personal data from users without authorization.
  • Infringe intellectual property or privacy rights of others.

7. Intellectual property and feedback

Bestorant retains all rights in its platform, software, and materials. If you submit product feedback, you grant Bestorant a non-exclusive right to use that feedback to improve services.

8. Third-party services

The services may include links and integrations with third-party products. We are not responsible for third-party terms, privacy practices, or service availability.

9. Disclaimer of warranties

The services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Bestorant disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Bestorant is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, business interruption, or data loss.

11. Indemnification

You agree to defend and indemnify Bestorant from claims arising from your misuse of the services, your violation of law, or your violation of third-party rights.

12. Suspension and termination

We may suspend or terminate access for violations of these Terms, security risks, legal requirements, or abuse. Obligations that by nature survive termination will remain in effect.

13. Governing law and dispute resolution

These Terms are governed by applicable U.S. and state law as specified in your order form or master agreement. Where required, disputes may be resolved by binding arbitration on an individual basis.

14. Changes to terms

We may modify these Terms from time to time. Material updates will be posted with a revised effective date.
